Gopal tells Troiano to resign

Monmouth Senator calls judge’s comments ‘despicable’

State Sen. Vin Gopal (D-Long Branch) has called for the ouster of Superior Court Judge James Troiano.

Troiano is facing criticism for comments he made about the alleged rape of a 16-year-old girl whose suspected assailant, also age 16, videotaped the assault.

“The comments made by Judge Troiano are despicable and beyond the pale. They have no place in our courts,” said Gopal. “Commentary and thinking like Judge Troiano’s cause further pain and suffering for survivors and put the legitimacy and fairness of our judicial system into question.”

Troiano, a former Cedar Grove mayor and Republican candidate for Essex County Executive, allowed the accused perpetrator to be tried as a juvenile because he came from a good family and was a candidate for a good college.

“Judge Troiano must resign, effective immediately, from any judicial posts he still holds – just based on his commentary and word-for-word thought process by his direct quotes,” Gopal said.  “Situations like these destabilize the public’s trust in our judicial institutions. His comments regarding the accused ‘coming from a good family’ are disgraceful.”

Gopal has been one of the Senate’s harshest critics of judges who mishandle sexual assault cases.

In April, he called for the resignation of Superior Court Judge John Russo after he asked an alleged rape victim if she attempted to close her legs to fend off her attacker.
