Two groups using similar names begin fight over trademark

New Jersey Future, an advocacy group that promotes smart growth, wants a group with a similar name, New Jersey Future Fund, to stop using their name.

The New Jersey Future Fund, which has run digital media ads on several news sites, including POLITICO and the New Jersey Globe, opposes aspects of Gov. Phil Murphy’s budget agenda.

In a  letter to the New Jersey Future Fund’s lawyer, Joseph Nardi of Brown & Connery, New Jersey Future attorney Christopher Ledoux of Greenbaum Rowe says that the similar names are creating “confusion in light of its apparent intent to inject itself into ongoing political debates and discussions in Trenton.”

  1. Yes, the name NEW JERSEY FUTURE is descriptive. But if their lawyers can prove that as a result of operating for over 30 years a substantial number of people associate the name with a particular company, they may be able to win. The real question is, if the legacy of the name is so important to you, why haven’t you bothered to trademark the name since 1987?
