Platkin announces legal victory against Florida ammunition retailer

Acting Attorney General Matt Platkin announced today that a court has ordered the Florida gun and ammunition retailer 22Mods4All Inc. to pay New Jersey a judgment of more than $175,000 for the company’s advertisement of illegal large capacity ammunition magazines (LCMs); the company will also now be prohibited from advertising or selling to New Jersey customers.

“This case marks another victory in our continuing efforts to hold online gun dealers accountable for advertising and selling dangerous firearm products to New Jersey residents even though they are illegal in our state,” Platkin said in a statement. “We are focused on using all of the tools available to us to stem the flow of illegal guns and firearms products into New Jersey from out of state.”

Under New Jersey state law, the possession of LCMs is a crime punishable by up to 18 months in prison, but according to Platkin, that didn’t stop 22Mods4All from advertising their LCM products to New Jersey customers.

“There was no disclaimer posted on the 22Mods4All website alerting prospective buyers that such LCMs are prohibited in New Jersey, and that possessing such ammunition is a crime in the state,” Platkin’s statement today said. “Likewise, there was no such disclaimer posted on the website’s sales checkout page.”

Thus, in December 2019, the state sued the company for violations of the Consumer Fraud Act, which prohibits companies from selling products in a deceptive manner.

“Our State banned the possession and sale of large capacity magazines for good reason: they can help kill and injure large numbers of people in a matter of seconds,” acting Director of the Division of Consumer Affairs Sean Neafsey said in the statement. “This company sold illegal large capacity ammunition magazines into the State, which put New Jersey residents at risk and exposed buyers to criminal liability.”

The battle with 22Mods4All isn’t the first time New Jersey has sued an out-of-state company for the advertisement and sale of LCMs. In January 2021, the state reached a settlement with another Florida gun company, Elite Aluminum Products Inc., that had sold LCMs to New Jersey customers; the state previously waged a similar fight against Nevada company New Frontier Armory that also ended in a settlement in 2020.
