Murphy should reopen filing deadline, Novak says

Ex-GOP congressional candidate files lawsuit against governor, says he might re-enter race

Barnegat Mayor John Novak is suing Gov. Phil Murphy for not reopening the filing deadline when he moved the June primary election to July, and might rejoin the race for the Republican nomination for Congress in New Jersey’s 3rd district.

Novak dropped his bid to take on Rep. Andy Kim (D-Marlton) last week and endorsed David Richter.

Richter had challenged Novak’s petitions for not having enough signatures.

“After reviewing the challenges and determining that certain signatures were, in fact, duplicates with other candidates the proper thing to do was to withdraw given that the deadline at that time had passed making it too late to obtain additional signatures,” Novak said.

Novak said he felt Richter “was the second best choice – and I still do feel that way.”

He is alleging that Murphy overstepped his legal authority by not extending the filing deadline, arguing that statutory authority rests with the legislative branch.
