Third Circuit sets fast-tracked schedule for line lawsuit stay

In a hugely accelerated process, the Third Circuit U.S. Court of Appeals today told parties seeking an emergency stay of U.S. District Court Zahid Quraishi’s decision to use office block ballots in the New Jersey Democratic primary and prohibit the use of county organization line that they need to file by midnight tonight.

Responses are due by 5 PM tomorrow, with replies filed by 10 AM Wednesday.

A panel of appellate judges could have a decision by late Wednesday or early Thursday, in time for ballot draws at 3 PM on Thursday — or not at all.

So far, the Camden County Democratic Committee, an intervenor in the original case, has filed a motion and the brief.

“The appeals are consolidated for purposes of scheduling, the joint appendix, the plaintiffs’ brief, and disposition. The court disfavors redundant briefing, so the appellants are encouraged to file a single, consolidated brief,” the Third Circuit court clerk, Patricia Dodszuweit, said in an order.  “If that is not practicable, they should consult with one another regarding the contents of their briefs and join in or adopt portions of the other’s brief by reference.”

There are 34 lawyers listed on the docket representing plaintiffs, defendants, and intervenors.
