Rep. Andy Kim (D-Moorestown) may testify in federal court on Monday in opposition to New Jersey’s county organization line system.
The three-term congressman and U.S. Senate candidate is the lead plaintiff in a lawsuit to abolish the line and is on a preliminary witness list submitted to lawyers today. A hearing is scheduled for March 18 in Trenton.
In a court filing today, Kim’s attorneys opposed a motion by the Camden County Democrats to intervene in the lawsuit. They suggested that Camden file an amicus brief instead.
“Given the current phase of litigation, and in light of the illusory interests asserted only to gain access but then turn around to be denied upon that grant of access, it becomes clear that intervention will ‘unduly delay’ and potentially even ‘prejudice’ adjudication,” Kim’s lawyers write in their brief.
The decision to allow the lawyer for the Camden County Democrats, Bill Tambussi, to have a seat at the table rests with U.S. District Court Judge Zahid Quraishi.
Quraishi must also decide whether he will grant a motion by county clerks in Essex, Union, and Passaic counties to dismiss Kim’s complaint.
