Judge rejects Parsippany mayor recount bid

Minkowitz says he wasn’t provided margin or date of certification

Superior Court Judge Stuart Minkwitz has rejected Parsippany Mayor James Barberio’s request for a recount,

Democrat Pulkit Desai scored an upset victory over Barberio in the November 4 general election, ousting the incumbent mayor by 80 votes.

Minkowitz said Barberio’s application failed to provide the court with the date of the election certification or the margin of victory.

“Even giving petitioner the benefit of all favorable inferences, petitioner fails to allege sufficient facts from which the court can determine whether the petition was filed within time conferring jurisdiction on the court,” Minkowitz said in an order issued today.

Barberio had claimed that four voters cast both vote-by-mail and provisional ballots.
